PERSONAL DATA PROTECTION POLICY

- PURPOSE OF THE PERSONAL DATA PROTECTION POLICY
The personal data protection policy has been developed and implemented in the structure of the data administrator in order to ensure compliance of the processing of personal data with the requirements of French and European legal acts in this regard, including the guidelines, including:
- Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) – hereinafter referred to as GDPR;
- The law of 10 May 2018 relating to the protection of personal data (consolidated text: Journal des lois de 2018, article 1000, modified), hereinafter the law;
- Guidelines of the Article 29 Working Party (now European Data Protection Board);
- Directives of the President of the Personal Data Protection Office;
- European Union Agency for Network and Information Security (ENISA) Guidelines;
The personal data protection policy applies to all natural persons whose data is processed by the data administrator.
- TERMINOLOGY
Data administrator (ADO) – TELLUSSIA limited liability company based in « Courtiron » 72340 MARÇON registered in the register of companies kept by the LE MANS court under the SIREN number: 420.862.930.
Personal data –information about an identified or identifiable natural person (« data subject »), where an identifiable natural person means a person who can be identified directly or indirectly, in particular on the basis of an identifier such as surname and first name, the identification number, location data, internet identifier or one or more elements specific to the physical, physiological, genetic, psychological, economic, cultural or social identity of a natural person;
Supervisory authority– for France, the National Commission for Computing and Liberties (CNIL) 3 place de Fontenoy, TSA 80715, 75334 PARIS CEDEX 07 (www.cnil.fr);
Third country– a country that does not belong to the European Economic Area;
Processor– a natural or legal person, public authority, unit or other entity which processes personal data on behalf of the data administrator;
Employee– a person cooperating with the data administrator on the basis of an employment contract or a civil law contract;
Treatment– an operation or a set of operations carried out on personal data or sets of personal data in an automated way or not, such as the collection, recording, organization, organization, storage, adaptation or modifying, uploading, viewing, using, disclosing by sending, distributing or otherwise sharing, matching or combining, limiting, deleting or destroying;
Consent of the data subject– means any freely specified, specific, informed and unambiguous indication of the data subject, by means of a statement or a clear affirmative action, expressing his consent to the processing of personal data relating to him. Consent must be properly documented to prove it;
EEA– European Economic Area
Profiling– means any form of automated processing of Personal Data, which consists of the use of personal data to evaluate certain personal factors of a natural person, in particular to analyze or predict aspects relating to the effects of work, the economic situation, an individual’s health, personal preferences, interests, reliability, behavior, location or movement;
Recipient– means a natural or legal person, public authority, agency or other body to which personal data is disclosed, whether or not it is a third party. However, public authorities likely to receive personal data in the context of a specific procedure under Union or Member State law are not considered to be recipients; the processing of this data by these public authorities must comply with the data protection rules applicable according to the purposes of the processing;
Cross-border processing – means:
(a) the processing of personal data which takes place in the Union in the context of the activities of establishments in several Member States of a controller or processor in the Union having establishments in several Member States; Where
(b) processing of personal data which takes place in the Union in the course of the activities of a single establishment of a controller or processor in the Union, but which significantly affects or is likely to significantly affect data subjects in more than one Member State;
International organisation– means the organization and its subordinate bodies governed by public international law, or any other body created by or on the basis of an agreement between two or more countries;
- RULES FOR THE PROCESSING OF PERSONAL DATA
The processing of personal data in the structure of the data administrator is carried out in accordance with the general rules for the processing of personal data set out in art. 5 GDPR. This means that personal data is processed:
3.1 in accordance with the law, based on at least one precondition for the lawfulness of the processing of personal data
3.2 fairly, taking into account the interests and reasonable expectations of the data subjects (principle of loyalty);
3.3 transparently for the persons concerned (principle of transparency);
3.4 for specified, explicit and legitimate purposes (purpose limitation principle);
3.5 to the extent adequate, relevant and necessary in relation to the purposes for which they are processed (principle of data minimization);
3.6 taking into account their accuracy and their possible updating (principle of accuracy);
3.7 for a period not exceeding that necessary for the purposes for which they are processed (principle of limitation of storage);
3.8 in a manner that provides appropriate security (integrity and confidentiality);
